Two months ago we introduced you same here this case opposing a police officer victim of a degassing of battery to an electronic cigarette shop. Accusing the seller of not having informed him, he claimed € 3000 from the sign that had sold him the product. Today, the Lille court has decided to dismiss him.


THE SELLER'S FAULT HAS NOT BEEN DEMONSTRATED!


On March 12, 2016, the CRS who was in the courtyard of their barracks suddenly saw their pants catch "fire". Indeed, the battery which is in his pocket and in contact with some coins. Almost two years later, he still has not returned to work and has undergone two skin grafts after third degree burns inside the right calf.

In the eyes of the victim, defended by the lawyer Alexia Navarro, this mysterious explosion could only come from the contact between the battery and the coins. Accusing the e-cigarette shop, he claimed 3000 euros for the damages. The Marcquois store, for its part, had sold the battery with instructions for use. 

Finally, the police officer has just been dismissed by the Lille court. " The court considered that we did not demonstrate the fault committed by the seller  », Underlines Me Alexia Navarro, lawyer of the victim. " It is possible that we make an appeal  »She adds.
