LAW: The ban on advertising applies for the e-cigarette!

Unfortunately, here is an announcement that was expected. The ban on advertising and propaganda, direct or indirect, which, since the Evin law, is applicable to tobacco products, now applies to vaping products. As of today, most platforms dealing with e-cigarettes are considered outlawed.

These advertising and propaganda bans, direct or indirect, apply for :

- the cigarettes,
- rolling tobacco, pipe or water pipe (hookah),
- cigars and cigarillos,
- chewing, snuff or oral tobacco,
- electronic vaping devices (e-cigarette or electronic cigarette), including cartridges, reservoirs and refill containers.

This advertising ban does not apply to:

- Tobacco store signs (commercial sign must be affixed on the front of each store, which can only mention the word "Tobacco", possibly supplemented by the name of the establishment and the representation of the carrot)
- Small posters (maximum dimensions: 60 x 80 cm) placed inside the sales establishment, not visible from the outside,
- Professional publications and online communication services which are only accessible to professionals, the list of which is fixed by decree.

Indirect advertising or propaganda consists in promoting an organization, a service, an activity or a product, which, by its design, its presentation, the use of a mark, a emblem Ban-de-advertising-to-the-cigarette-electronicsadvertising or any other distinctive sign, recalls a tobacco product.

In addition, any sponsorship, sponsorship or patronage operation is prohibited when it is carried out by manufacturers and distributors of tobacco or vaping products, or when it constitutes direct or indirect advertising in favor of tobacco or vaping.

However, the retransmission of motor sport competitions (races or rallies of cars or two-wheelers), which take place in a country where advertising for tobacco is allowed, can be provided by the television channels.

Failure to comply with these prohibitions is punishable by a fine of € 100 or € 000 in the event of a repeat offense.
