The Helvetic Vape Association considers the TAF judgment, which breaks the administrative decision of the FSVO perpetuating the unjustified prohibition of nicotine-containing vaping products in Switzerland, to be a major step forward.
The judgment of the Federal Administrative Court (TAF) of 24 April 2018, published today, is very clear, the Federal Office for Food Health and Veterinary Affairs (OSAV) did not have jurisdiction to prohibit the professional import and the sale of a whole category of products. The TAF, relying on case law, considers that this abuse is a serious fault of the federal administration. The FSVO has 30 days to possibly file an appeal before the Federal Court. The association Helvetic Vape, which denounces this prohibition since 2013, regrets that it took a court decision to begin to make the federal government listen to reason.
The administration's stubbornness in maintaining an unjustified and illegal prohibition for 10 years is symptomatic of the lack of consideration of federal officials and Mr. Alain Berset for the right to access to tools for minimizing the damage associated with the consumption of nicotine. . Switzerland has already fallen far behind neighboring countries which have long allowed, and without any particular problem, the sale of nicotine vaping products. The Helvetic Vape association is now waiting to see how the administration will react to the TAF judgment and what the related consequences will be.
The Helvetic Vape association considers that the placing on the Swiss market of nicotine vaping products will greatly accelerate the movement of conversion of nicotine users to consumption methods that are much less risky for health than combustible tobacco.
