During the Council of Ministers of March 22, 2017, the Minister of Social Affairs and Health, Marisol Touraine, presented a bill ratifying Ordinance No. 2016-1812 of December 22, 2016 relating to the fight against smoking and its adaptation and extension to certain overseas communities.
ADAPTATION OF THE FIGHT AGAINST TOBACCO IN CERTAIN Overseas Communities
The ordinance to be ratified, taken on the basis of articles 216 and 223 of the law of January 26, 2016 on the modernization of our health system, extends and adapts the anti-smoking measures to communities of overseas governed by article 73 of the Constitution, in Saint Barthélémy, Saint Martin, Saint Pierre Miquelon and Wallis-et-Futuna.
Several specificities indeed required the adaptation of Ordinance No. 2016-623 of May 19, 2016 for these territories in which there is no tobacco sales monopoly and where the tobacco price approval procedure does not exist. do not apply.
The ordinance also made several modifications to the aforementioned ordinance. It thus clarified the existing provisions in order in particular to strengthen the security of procedures with regard to the collection of rights paid by manufacturers of vaping and tobacco products or the methods of affixing health warnings for certain tobacco products with specific packaging.
Finally, the ordinance determined the competent authority for the approval of laboratories responsible for analyzing emissions from tobacco products. This ordinance thus marked a new stage in the implementation of the National Tobacco Reduction Program 2014-2019, contributing to its objective of reducing the number of daily smokers in the coming years.
