In Lons-le-Saunier in the Jura, parents filed a complaint against a trader who sold an electronic cigarette to their 13-year-old son. If they claim "respect for the law", it is not yet implemented as a lawyer explains.
According to the daily Le Progrès, the boy went a few days ago with two other teenagers, also aged 13, to buy electronic cigarettes. The appliance store had nevertheless posted on its window that it did not sell any to minors.
The mother of one of the children remains lucid about the behavior of the college students. “My kid knew what he was doing. The principal of the college made it clear to me. A lot of kids have this kind of material in college. "
At the end of 2013, the European Parliament ruled on the classification of electronic cigarettes in the category of medical products. As it had been rejected, the e-cigarette could since remain in free sale, but prohibited from sale to minors… when the law would be adopted then transposed in each country of the Union.
Questioned on the subject, Maître Echalier, a lawyer at the Toulouse Bar, confirms that« for now, the rule is not clear enough« . Prohibition of sale to minors« is in a bill on consumption… These are WHO recommendations which aim to limit the sale to minors« .
To comment on the Lons-le-Saunier case, the lawyer takes the example of a tobacconist « which has no legal prohibition« finally, to sell to the miners.
With her complaint, the mother of one of the three boys then hopes to draw general attention to this lack of control on the part of the sellers. « I would like there to be a law that would say that this kind of equipment can only be sold in specialized stores and not anywhere, anyhow. And that the sellers make sure of the age of the people to whom they sell this material!«
