It is a real liberal current which is taking hold of the world concerning electronic cigarettes. After the authorization of nicotine e-liquids in Switzerland a few days ago, it is New Zealand's turn to obtain this long-awaited decision.
AN EXPECTED LEGALIZATION OF NICOTINE FOR VAPOTAGE!
It's in a official release published a few days ago now that the decision was announced by the New Zealand government. Nicotine vaping products and heated tobacco products are legalized in the country and this is a relief for many users for whom the situation was complicated.
In its writings, the government specifies that in the case between Philip Morris and the Ministry of Health, the district court concluded that all tobacco products (except types that are chewed or dissolved in the mouth) could be legally imported, sold and distributed under the Smoke-Free Environment Act 1990 (SFEA).
No appeal having been made, the same regulatory controls of the SFEA now apply to smoked tobacco, heated tobacco and vaping products with nicotine. This therefore includes the prohibition on sales to minors and restrictions on advertising.
It is stipulated that " The ban on smoking in indoor workplaces and schools applies only to smoking. It does not apply to vaping or products that are not smoked, such as heated tobacco products. Employers and business leaders can decide whether or not to include vaping in their smoke-free policies. "
WAITING FOR PROPORTIONAL REGULATIONS!
The Ministry of Health is currently studying how best to regulate vape products and heated tobacco proportionally. Pending the amendment of the SFEA, sellers must continue to trade responsibly and, in particular, not to advertise or sell vaping products to children and young people under the age of 18.
For tobacco companies like Philip Morris it is also a victory as heated tobacco products could very quickly be available for sale in New Zealand.
