Cigarettes are theoretically prohibited in enclosed and covered spaces. But many cafes do not follow the law. Two of them have just been sentenced in Paris.

A closed terrace in a Parisian café, on the Grands Boulevards. It's cold outside, the rain is falling. And people smoke while sipping their coffee. Three young girls are amazed when they are pointed out that they are breaking the law: “Ah yes… We don't have the right. By force, on the terraces, we no longer know if it is authorized or not ... But if someone complains, I immediately put out my cigarette", Says Lola, 22 years.

His girlfriend nods. "In general, it goes well with non-smokers. I do not feel that it bothers.Yet the regulations are clear: smoking is prohibited in establishments open to the public. You can only do this on the terrace if it is not covered or if its main entrance is fully open..

But this regulation is far from being respected. At the end of a long procedural battle, the association Right of non-smokers (DNF) has just had two outlaw establishments condemned by the Paris Court of Appeal. Self-service Royal, which manages the Zéphyr café, boulevard Montmartre in Paris, will have to pay € 40 to DNF. The bailiff's observations showed that his terrace was well closed, that ashtrays were made available to customers and that, despite injunctions, nothing was done to dissuade people from smoking. The company did not respond to our maintenance requests.
