TOTALLY WICKED: A badly embarked court challenge.

According to an advocate general of the European Court of Justice, the regulation on e-cigarette production, sale and marketing (TPD) which is due to come into force across Europe next year remains relatively moderate and not breaking European law.

totallyThe opinion of the Advocate General, Juliane Kokott is a severe blow to e-cigarette manufacturers who claimed that the future of nicotine-based products was in peril with this new regulation even as the NHS announced a few months ago that e-cigarettes were 95% less harmful than tobacco.

However, this notice does not mean that the court will automatically reject the court challenge to Totally Wicked, which moreover is supported by other manufacturers, but we know, however, that most judgments follow the position of the Advocates General. For this case, judgment is expected early next year.

Totally Wicked, which also operates in the United States and Germany, argued that the restrictions on the capacity of e-liquid bottles, on the strength of nicotine, on advertising as well as on other points, would clearly harm this nascent industry while noting that the e-cigarette would be subject to more stringent regulations than that imposed for certain tobacco products.
