Since the FDA's e-cigarette regulatory regime came into effect in August 2016, only 39 products have received marketing authorization, including NJOY's menthol kits, which were approved last year.
A favor based on the benefit/risk balance
The regulator has validated five Juul references, considering that the health benefits outweigh the risks, notably the possible diversion towards young consumers.

Juul CEO KC Crosswaite said, "This is a significant milestone for our company." He said the products represent an opportunity to replace unregulated disposable vapes, often sourced from China.
For its part, the FDA has acknowledged that it needs additional resources to speed up approval processes, as some applications have been stagnating for years.
Towards a regulated and safer market?
Juul plans to submit new applications for approval to expand its product line. At the same time, the industry is hoping for a simplification of regulatory requirements, particularly under President Trump. The FDA has faced criticism for its slowness and lack of decisiveness in the face of unauthorized products flooding the market.
