Public health: France chooses repression against nicotine

France faces emerging nicotine products: a ban policy in question

On February 24, 2025, French authorities officially notified the European Union of their intention to ban nicotine pouches. This decision follows the adoption, a few days earlier, of a law banning disposable e-cigarettes, commonly known as "puffs."

A political will targeting young people

Puffs, often presented in attractive packaging with sweet or fruity flavors, are suspected of seducing adolescents, encouraging them to start using nicotine early. Pouches, meanwhile, although tobacco-free, are also perceived as products that facilitate the development of nicotine addiction.

Minimal but alarming health data

Authorities are putting forward figures reporting cases of poisoning linked to the use of these bags. However, official data collected between 2017 and 2022 only recorded 47 incidents attributed to the pouches, figures that put the urgency of a general ban into perspective. These statistics call into question the true basis of this health strategy.

A policy criticized by health professionals

Several public health experts believe that a sudden ban risks having counterproductive effects. These specialists advocate instead for strict regulation, highlighting the potential of these products as alternatives to traditional cigarettes. Abroad, countries like Sweden have adopted a harm reduction approach that appears to be bearing fruit, notably through a significant drop in smoking rates.

A European regulatory step in progress

Notification to the European Commission is a necessary formality before the ban can be effectively implemented. The Commission has three months to analyze the French request and assess its compatibility with Community law. This mechanism aims to ensure harmonization of policies between Member States while respecting existing legal frameworks.

Impact on the market and consumers

If the measure were to be validated, consumers would have to shift to other forms of nicotine consumption, such as pharmaceutical substitutes or rechargeable electronic devices. The vaping and tobacco-free product industry would be forced to adapt to a new regulatory reality, with the potential for economic losses and significant structural adjustments.

Between prohibition and harm reduction strategy

France's position today appears to be one of prohibition against nicotine innovations. This choice raises many questions about its actual effectiveness in the fight against smoking. The debate remains lively between supporters of a systematic ban and those who advocate a public health policy focused on risk reduction, which is more pragmatic and potentially more efficient in the long term.
