« We may be the initiators of this challenge, but we hope that all vapers and the entire electronic cigarette industry will support it. We want it to be our challenge, that of the vapers, that of the cigarette and electronic liquid industry, because if the Tobacco Products Directive is put in place in its current form we will all be losers.
We launched this legal challenge against the Tobacco Products Directive (TPD) of the European Union last year, based on the fact that Article 20 of the Directive infringes EU law.
More precisely, this dispute is based on the principle that TPD 20 disproportionately interferes with the free movement of goods and services, puts the e-cigarette at an unjustified competitive disadvantage in relation to tobacco products, does not respect the general principle of EU equality and violates the fundamental rights of manufacturers and users of electronic cigarettes.Le 6th October, 2014, Royal Court of Justice from the United Kingdom, Justice Green has sent a reference for a preliminary ruling so that the Court of Justice of the European UnionTPD Article 20 actually violates EU law. The hearing of ECJ should be held later this year.
With this decision, we became the first electronic cigarette company to win the right to challenge a Directive that will allow e-cigs and their liquids to be governed by the same regulatory framework as tobacco, which regulates them more. strictly as tobacco products.The electronic cigarette is not a tobacco product, but a revolutionary product, potentially able to make tobacco obsolete and prevent millions of deaths from smoking. We are convinced that TPD may restrict access to good quality electronic cigarettes and liquids, and may hinder their ability to change lifestyle.
