UNITED STATES: FDA attacks 10 vape companies with warning letters

Other vape companies, like Juul Labs, in San Francisco, had previously suspended sales of flavored pods and submitted product requests for review through the FDA's Pre-Market Application Process (PMTA).

On July 20, the FDA sent warning letters to 10 companiesIncluding Cool Clouds Distribution Inc., dba Puff Bar, in order to withdraw from the market disposable flavored e-cigarettes and e-liquids attractive to young people because they do not have the required pre-marketing authorization.

The FDA Commissioner, Stephen hahn states: " We are concerned about the popularity of these products with young people and want to convey to all manufacturers and sellers of tobacco products that, even during the current pandemic, the FDA is monitoring the market closely and holding companies accountable. »

The FDA said that Puff bar, HQD Tech USA LLC et Myle Vape Inc. illegally marketed disposable vaping products introduced or modified for the first time after August 8, 2016, i.e. after the effective date of the regulations that extended the authority of the FDA to all tobacco products. New tobacco products that do not meet the pre-market requirements of the Federal Food, Drug and Cosmetic Act cannot be marketed without clearance from the FDA, the administration said.

Warning letters were also sent to USA, Vape Deal LLC, Majestic Vapor LLC, E Cigarette Empire LLC, Ohm City Vapes Inc., Breazy Inc., et Hina Singh Enterprises, dba Just Eliquids Distro Inc., accused by the FDA of offering nicotine vape products aimed at young people without authorization. Unauthorized e-liquids mimic food packaging that young people often like, such as cereal Cinnamon Toast Crunch, Twinkies, Cherry Coke  the FDA said.

The FDA has asked each company to respond within 15 business days with a plan for how each company will respond to the agency's concerns. Failure to correct the violations could result in a civil complaint, seizure or injunction.

On July 21, the Puff Bar website responded by posting a message announcing the cessation of all online sales and distribution in the United States until further notice.
